EATTOFIT – TERMS & POLICIES.

1. INTRODUCTION

These Terms & Conditions ("Terms") govern your access to and use of the EattoFit website, mobile platform, and services (collectively, the "Platform"), operated by EattoFit WLL, a company registered in the Kingdom of Bahrain under Commercial Registration No. [CR Number] ("EattoFit", "we", "our", or "us"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Refund & Cancellation Policy, and any other policies referenced herein. These documents together form the entire agreement between you and EattoFit. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform. You consent to receive electronic communications from EattoFit, including order confirmations, updates, and legal notices via email, SMS, or in-app notifications. These Terms apply to all users of the Platform, including visitors, registered users, and customers placing orders.

2. ABOUT EATTOFIT

EattoFit is a digital food customization and ordering platform that enables users to:

• Build and fully customize meals based on personal preferences
• Adjust ingredients, portions, and macronutrient composition in real time
• Order freshly prepared, cook-to-order halal meals for delivery across Bahrain

EattoFit does not provide medical, dietary, or nutritionist consultation services. Nothing on the Platform constitutes professional health advice.

3. ELIGIBILITY & ACCOUNT RESPONSIBILITY

To use the Platform and place orders, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete information
• Maintain the confidentiality of your account credentials
• Notify EattoFit immediately of any unauthorized access or use of your account

If a person under 18 uses the Platform, such use must occur through an account registered by a parent or legal guardian, who assumes full responsibility. You are responsible for all activities that occur under your account. EattoFit is not liable for any loss or damage arising from unauthorized account access resulting from your failure to maintain account security. EattoFit reserves the right to refuse service, suspend, or terminate any account at its sole discretion.

4. NATURE OF SERVICE

EattoFit provides:

• A technology platform for meal customisation
• Order processing and delivery coordination
• Informational nutritional data

EattoFit does not guarantee any health or fitness outcomes.

5. HEALTH & NUTRITION DISCLAIMER

• Nutritional information is approximate and for informational purposes only
• EattoFit does not provide medical advice or treatment
• Results related to diet or fitness are not guaranteed

You use the Platform at your own risk and are responsible for your dietary choices.

6. ALLERGIES & USER RESPONSIBILITY

Meals may contain allergens and cross-contamination may occur.

You agree that:

• You are responsible for reviewing ingredients
• You must avoid allergens relevant to you
• EattoFit is not liable for allergic reactions, to the maximum extent permitted by applicable law

7. ORDER FORMATION & CUSTOMIZATION

A binding contract is formed when you submit an order through the Platform and receive an Order Confirmation issued by EattoFit.

You are responsible for verifying:

• Ingredients and portions
• Delivery details
• Timing

Once confirmed:

• Orders cannot be modified beyond the cancellation window
• Errors remain the user's responsibility

EattoFit reserves the right to refuse, limit, or cancel any order prior to Order Confirmation due to system errors, pricing inaccuracies, operational constraints, or ingredient availability, without liability.

8. PRICING & PAYMENT

• All prices are in BHD
• Prices may change without notice
• Payment is required in advance

Accepted payment methods include credit/debit cards, BenefitPay, Apple Pay, and other methods as made available on the Platform. Prices may include VAT and exclude delivery fees, as shown at checkout. EattoFit reserves the right to refuse or cancel orders where payment authorization fails.

9. DELIVERY POLICY

• Delivery is limited to service zones
• Time slots are estimates only

If delivery cannot be completed due to customer-related reasons, EattoFit will attempt to contact you using the details provided and wait for up to 5 minutes at the delivery location. If delivery remains unsuccessful after this process, the order will be deemed delivered and fulfilled and will be non-refundable to the maximum extent permitted by applicable law. Risk of loss and responsibility passes upon the first delivery attempt.

10. FOOD SAFETY & STORAGE

You are responsible for:

• Refrigeration (≤ 4°C)
• Consumption within 2–3 days
• Safe reheating

EattoFit is not liable after delivery, to the maximum extent permitted by law.

11. CANCELLATION & REFUND POLICY

Cancellations and refunds are governed exclusively by the EattoFit Refund & Cancellation Policy, which forms an integral part of these Terms. Cancellation windows vary by order type (e.g., immediate vs scheduled) and are detailed in the Refund & Cancellation Policy. Orders become non-cancellable once preparation begins, regardless of any displayed cancellation window. Displayed cancellation windows are indicative only and may be shortened or overridden if meal preparation begins earlier based on operational requirements, as further detailed in the Refund & Cancellation Policy. Approved refunds, if any, will be processed within 3–5 business days from approval as wallet credit or to the original payment method. Where required by applicable law, refunds will be issued to the original payment method. All refund determinations are made in accordance with the Refund & Cancellation Policy and are subject to verification and approval by EattoFit. In the event of any inconsistency between these Terms and the Refund & Cancellation Policy, these Terms shall prevail. EattoFit reserves the right to refuse refunds in cases of suspected fraud, abuse, or misuse of the Platform. Cancellation windows, refund conditions, and processing timelines are strictly enforced and determined based on system timestamps and operational logs.

12. SUBSCRIPTIONS

13. WALLET SYSTEM

• Non-transferable.
• No cash value.
• Subject to expiry and any additional conditions set out in the Refund & Cancellation Policy.
• Maximum balance: 500 BHD.

EattoFit reserves the right to:

• Modify wallet limits
• Reverse incorrect credits.
• Freeze accounts.
• Forfeit balances in case of misuse.
• Modify expiry rules or conditions with reasonable notice where required by applicable law

Wallet balances are promotional or service credits and do not constitute stored monetary value, deposit accounts, or financial instruments. Wallet balances are not redeemable for cash and do not constitute electronic money, deposits, or any regulated financial instrument under applicable law.

14. CARE CHAIN

CARE CHAIN is a voluntary support feature.

• Contributions are non-refundable.
• Distribution is controlled by EattoFit.
• No financial return is provided.

CARE CHAIN is intended as a voluntary goodwill feature and is not designed as a financial service or investment product. Its regulatory classification, if any, may be subject to applicable laws. EattoFit reserves the right to modify, suspend, or discontinue CARE CHAIN at any time in compliance with such requirements.

15. ACCOUNT RESTRICTIONS

Prohibited conduct includes:

• Fraudulent activity.
• System abuse or manipulation.
• Unauthorized resale.
• Impersonation.

EattoFit reserves the right to suspend or restrict access to the Platform at any time for operational, security, or compliance reasons.

16. INTELLECTUAL PROPERTY

All Platform content is owned by EattoFit and protected by applicable intellectual property laws.

No copying, redistribution, or reuse is permitted without our prior written consent.

17. THIRD-PARTY SERVICES

We may use third parties for:

• Delivery.
• Payments.

We are not liable for their failures, to the maximum extent permitted by applicable law.

18. COMMUNICATIONS

By providing your contact details, including your phone number and email address, you expressly consent to receive transactional, operational, and service-related communications from EattoFit, including:

• Order confirmations.
• Delivery updates.
• Customer support communications.

Message frequency may vary. Standard messaging and data charges may apply based on your mobile service provider. You may opt out of promotional communications at any time by following the instructions provided. However, you may continue to receive essential service-related communications necessary for order fulfillment and account management. EattoFit is not responsible for delays, delivery failures, or technical issues in communication caused by third-party network providers or service interruptions. You confirm that the contact details provided are accurate and belong to you, and you are authorised to receive communications at those contact points.

19. USER CONTENT

The Platform may allow you to submit reviews, feedback, testimonials, ratings, or other content ("User Content"). By submitting User Content, you grant EattoFit a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display such content for operational, marketing, and promotional purposes without further notice or compensation.

You agree that your content:

• Is accurate and not misleading.
• Does not violate any law or third-party rights.
• Does not contain offensive, unlawful, or inappropriate material.

EattoFit reserves the right to remove, edit, or refuse any User Content at its sole discretion.

20. PRODUCT REPRESENTATION & VARIATION

All product descriptions, images, and nutritional information are provided for informational purposes only. Due to the customizable and freshly prepared nature of our meals, actual products may vary based on:

• Ingredient availability.
• User-selected customisation.
• Preparation methods.
• Natural variation in ingredients.

EattoFit does not guarantee exact visual, nutritional, or portion consistency. Images are for illustrative purposes only and may not represent the exact final product. Minor deviations in portion size, presentation, or ingredient composition shall not constitute a defect.

Customization Responsibility

All meals are prepared based on your selections.

You are solely responsible for:

• Reviewing ingredients.
• Confirming customization choices.

EattoFit is not liable for dissatisfaction resulting from user-selected configurations or input errors.

Display Variations

Product appearance may vary depending on device, screen, or browser settings. EattoFit is not responsible for such variations.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, EattoFit and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform or any meals or services provided. Consumption of food products is at the user's own risk, subject to the allergen and health disclaimers outlined in these Terms. EattoFit's total aggregate liability shall not exceed the total amount paid by you to EattoFit for the order giving rise to the claim.

EattoFit is not liable for:

• Indirect or consequential damages.
• Health outcomes or fitness results.
• Delivery delays beyond our reasonable control.
• User errors, including incorrect information or misuse of the Platform.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded under applicable law.

21.1 DISCLAIMER OF WARRANTIES

The Platform is provided on an "as is" and "as available" basis.

We do not guarantee:

• Accuracy, completeness, or reliability of data.
• Uninterrupted, secure, or error-free service.
• Suitability of the Platform for any particular purpose.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is not permitted under applicable law. Use of the Platform and any meals ordered is at your sole risk.

22. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless EattoFit, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Platform.
• Your breach of these Terms.
• Any violation of applicable law or the rights of a third party.

23. FORCE MAJEURE

We are not liable for any delay or failure to perform obligations due to events beyond our reasonable control, including but not limited to:

• Natural disasters.
• Government restrictions or regulations.
• Power or telecommunications outages.
• Labour disputes.
• Strikes or civil unrest.

24. PRIVACY

Your personal data is collected, used, stored, and processed in accordance with our Privacy Policy, which forms part of these Terms.

25. MODIFICATIONS

We may update these Terms from time to time. Where changes are material, we will provide advance notice through the Platform and/or by email or in-app notification. Continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the updated Terms.

26. GOVERNING LAW

These Terms and any disputes arising out of or relating to them or to your use of the Platform shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Bahrain.

27. SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the policies referenced herein, constitute the entire agreement between you and EattoFit regarding the use of the Platform and supersede any prior understandings or agreements.
